Basic installation
The following terms and conditions apply to all contracts you enter into with us as a supplier. Unless otherwise agreed, the inclusion of our own terms and conditions is excluded.
A consumer within the meaning of the following provisions is any natural person who carries out a legal act not primarily attributable to his commercial or independent professional activity. An entrepreneur is any natural or legal person or company with legal capacity acting in the exercise of their independent professional or commercial activity when concluding a legal transaction.
Choice of applicable law, place of execution, competent jurisdiction
German law applies. For clients, this choice of law only applies if it does not deprive the client of the protection offered by the mandatory provisions of the law of the country of habitual residence of the client (principle of credibility).
If you are not a consumer but a merchant, a legal entity under public law or a special public fund, our registered office is the place of jurisdiction and performance for all relations with us arising from the conduct of business. This also applies if you do not have a court of general jurisdiction in Germany or the EU, as well as if your domicile or habitual residence is unknown at the time of submitting the application. This does not affect the possibility of bringing a claim in a court of another jurisdiction.
The provisions of the United Nations Convention on Contracts for the International Sale of Goods are expressly not applicable.
Individually designed products
Immediately after conclusion of the contract, you must provide us with the information, texts or data necessary for the individual design of the products via the online ordering system or by e-mail. All file formats specified by us must be respected.
You are responsible for ensuring that you do not transmit information whose content infringes the rights of third parties (in particular copyright, name and trademark rights) or violates applicable laws. You expressly indemnify us against claims by third parties in this regard. This also applies to the costs of legal assistance required in this regard.
We do not check the correctness of the content of the data transmitted. We assume no liability in the event of an error.
Conclusion of the contract
The subject of the contract is the sale of products and/or the provision of repair services.
Once you have placed the product in question on our website, we make a binding offer to you via the online shopping cart system to conclude a contract on the conditions specified in the item description.
The purchase contract is concluded via the online purchasing system as follows:
Products and/or repair services intended for purchase are moved to the "cart". You can select the shopping cart using the corresponding buttons in the navigation bar and make changes at any time.
After you call up the "Order" page and enter your personal data and the payment and shipping conditions, you can see the order details in the form of an order summary.
If you use a direct payment system (e.g. PayPal/PayPal Express, Amazon Payments, Instant Bank Transfer) as a payment method, you will be redirected to the order summary page in our online store or to the website of the provider of the direct payment method.
When you are directed to the respective direct payment system, you must select and/or enter the appropriate data. Finally, on the website of the direct payment system provider or after referral to our online store, the order details are displayed in the form of an order summary.
Before submitting the order, you have the option to re-check or change the information on the order summary page (you can also use the "Back" button on your web browser) or cancel the purchase .
By clicking on the "Order subject to payment" button to validate the order, you declare that you accept the legally binding order, thus creating the purchase contract.
You are not bound by the offers you send to us. We make you a textual and binding offer (e.g. by e-mail), which you can accept within 5 days.
Execution of the order and sending of all necessary information takes place within 5 days.
